1. Eligibility

• Users under the age of 18 must have explicit parental or guardian consent.
• Institutional accounts must ensure compliance with these Terms by their authorized users.

2. Services Description

YoLearn.AI provides AI-driven educational tools including personalized AI tutors, lesson planners, assignment creators, learning analytics, progress trackers, and interactive avatars.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. Inform YoLearn.AI immediately if unauthorized access occurs.

4. User Content and Avatars

• Users may create educational content and personalized avatars for educational purposes.
• Users retain intellectual property rights to content they create and upload.
• By uploading content, you grant YoLearn.AI a worldwide, non-exclusive, royalty-free license to use this content to deliver and enhance our Services.

5. Privacy and Data Protection

YoLearn.AI's Privacy Policy details our collection, use, and protection of your personal data in compliance with the Digital Personal Data Protection Act (India), GDPR, and COPPA.

6. Subscription and Payments

• Payments are processed securely through Razorpay.
• Subscription plans (monthly, quarterly, annual) auto-renew unless canceled by the user.
• Usage beyond subscription limits may incur additional charges as detailed during subscription.

7. Content Moderation

YoLearn.AI reserves the right to review, moderate, remove or restrict content that is inappropriate, misleading, harmful, or violates our educational standards and policies.

8. Intellectual Property

• YoLearn.AI trademarks, logos, mascots, and branding (e.g., "Yo" the penguin) are proprietary to YoLearn.AI.
• Unauthorized use of YoLearn.AI's branding or IP is strictly prohibited.

9. Compliance and Security

YoLearn.AI maintains robust security measures and complies with ISO, SOC, and GDPR standards to protect user data.

10. Limitation of Liability and Indemnification

YoLearn.AI is not liable for indirect, incidental, consequential damages or loss of profits arising from the use of our Services. Users agree to indemnify YoLearn.AI against claims arising from misuse of our Services or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms will be governed by Indian law and shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the venue in New Delhi, India.

12. Export Compliance

Users must comply with Indian and applicable international export control laws and regulations in using our Services.

13. Modifications and Termination

YoLearn.AI reserves the right to modify or discontinue any part of the Services with prior notice. Users will be notified of significant changes through service notifications or email.

14. Additional Provisions for Institutions

Educational institutions subscribing to YoLearn.AI Services must ensure adherence to these Terms by their staff, students, and other authorized users.
